 Policy Overview 

The electric power industry achieved several important victories in 2011, in the face of many considerable challenges.  Among other legislative achievements, EEI helped to secure congressional repeal of the 3% withholding provision, thus eliminating a costly administrative burden for utilities. EEI also continued its work to ensure that rules implementing the 2010 Dodd-Frank financial reform law adhere to congressional intent to exempt utilities that use over-the-counter (OTC) derivatives to manage commodity risk on behalf of their customers. This section presents an overview of the legislative and regulatory policies affecting the electric power industry.
